If you do not agree to these Terms of Use, please do not use the website. The materials contained in this Website are protected by applicable copyright and trademark law.

Your access to and use of this Website is subject to the following terms and conditions (“Terms of Use”) and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect:
You are granted a fully revokable license to use the materials (information or software) from Jaime Komer for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on the Website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or "mirror" the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Jaime Komer at any time. You may not distribute content, print multiple copies, or use the content for public display or performance unless otherwise stated. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
By accessing this Website, you agree that you will not use what you have access to here to create a competing website, product, or service; and, that you will not create any work that compiles or derives from what you have access to here; and, that you will not use this Website or services in any manner that violates this agreement or any local, state, federal, or international laws.
Jaime Komer Products and Services
Jaime Komer products and services include but are not limited to: Courses, Kampfire Community, Cohorts and Coaching.
Private Coaching and Cohorts
1. As a client, I understand and agree that I am fully responsible for my physical, mental and emotional well-being during my coaching calls, including my choices and decisions. I am aware that I can choose to discontinue this coaching / course at any time.
2. I understand that “coaching” is a Professional-Client relationship I have with my coach that is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.
3. I understand that coaching is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education and recreation. I acknowledge that deciding how to handle these issues, incorporate coaching into those areas, and implement my choices is exclusively my responsibility.
4. I understand that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association. I understand that coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of diagnosis, treatment or therapy.
5. I understand that coaching is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other qualified professionals. I will seek independent professional guidance for legal, medical, financial, business, spiritual or other matters. I understand that all decisions in these areas are exclusively mine and I acknowledge that my decisions and my actions regarding them are my sole responsibility.
6. Cancellation and Refund policy: a full refund will be given if I cancel within seven (7) days of the start of the first coaching call. A 50% refund will be given if cancelled within a week (1-6 days) prior to the start of the first call. If cancelling a scheduled call, cancel within 24 hours of a call and reschedule accordingly. If cancellation is less than 24 hours before the call, there is a full forfeiture of the price of the call.

Membership Site Terms and Conduct
Upon joining The Kampfire (membership), or any other products you will be given access to a members' only area of The Kampfire Content Library inside Squarespace.com (“Squarespace”) or Thrivecart.com (“ThriveCart”) via secure link and login using an email and password. You agree to not share your login credentials or the secure link with anyone for any reason. You will not share your username and password with any person who did not pay for access to these programs. You also agree that you will not sell access to these programs and will not sell any of its content without written permission.
Use of content, unless otherwise stated, is for your own personal, non-commercial use. You may not distribute content, print multiple copies, or use the content for public display or performance unless otherwise stated.
You understand and agree to not place an unreasonable burden on the server hosting this Website or membership site, to not interfere with the running of this Website and to not attempt unauthorized access to any portion of this Website.
You understand and agree not to provide false information about yourself, to impersonate another individual or provide misleading or false content.
Refund and Return Policy
Due to the digital nature of our products, Jaime Komer only offers a refund on any product or service that hasn't commenced. Jaime Komer does not offer refunds or returns for any reason due to the digital nature of the product. Membership Types
Jaime Komer / The Kampfire offers one membership type.
Recurring Payments
All completed purchases for any Monthly Payment offer towards your Membership includes your agreement to participate in the 30-day cycle of recurring payments associated with your Membership.
You understand that you are responsible for any missed or failed payments due to canceled, changed, or altered payment information that you do not provide to us.
Failure to pay does not cancel your Membership payment obligation. If we cannot collect your monthly payment, your membership will be suspended by us and an outstanding balance will be placed on your account.
You are responsible for all outstanding membership balances whether or not you maintain an active membership. We reserve the right to collect any and all payments due to us using our collection agency.
Payments
You represent and warrant that when makes purchases from Jaime Komer that any credit card or payment information you give us is accurate and complete; and, any charges incurred by you will be honored by your financial institution or credit card company; and, you will pay the charges incurred by you, including any and all taxes; and, if your payment method is not honored for any reason, you will still pay any incurred charges, including any surcharge we may incur due to the failed payment.
When you join The Kampfire on a Monthly Payment for the Membership, you will pay upfront for the first month in full. You must provide current, complete, and accurate billing and credit card information. You must promptly update all billing information (such as billing address, card number, and expiration date) to keep your account current, complete, and accurate, and you must promptly contact us if your credit card is lost or stolen, or if you become aware of a potential breach of account security (such as an unauthorized disclosure or use of your Sign-In Name or Password).
You hereby authorize the Owner, Jaime Komer, to obtain or determine updated or replacement expiration dates for your credit card in the event that the credit card you provided us expires. We reserve the right to charge any renewal card issued to you to the same extent as the expired card. If payment is not received from your credit card issuer, you hereby agree to pay all amounts due upon demand. You agree to pay all costs of collection, including attorney’s fees and costs, on any outstanding balance. In certain instances, the issuer of your credit card may charge you a foreign transaction fee or related charges, which you will be responsible to pay. You are advised to check with your bank and credit card issuer for details.

Jaime Komer makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Jaime Komer does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

You hereby consent to binding arbitration in the State of Washington to resolve any disputes arising under this Terms and Conditions.
ARBITRATION MUST BE ON AN INDIVIDUAL BASIS. THIS MEANS NEITHER YOU NOR WE MAY JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER CUSTOMERS, OR LITIGATE IN COURT OR ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.
